These Terms of Service govern access to and use of RailsVerifiedApp, operated by Four Eyez Company LLC.

“Patent Pending”

1. Acceptance

By accessing or using RailsVerifiedApp, you agree to these Terms.

2. Authorized Use

RailsVerifiedApp is intended for authorized industrial, operational, enterprise, and business use. Access may be restricted by role, organization, site, account, or deployment settings.

3. License

Four Eyez Company LLC grants a limited, revocable, non-exclusive, non-transferable license to use RailsVerifiedApp in accordance with these Terms and any authorized deployment arrangement.

4. Decision-Support Only

RailsVerifiedApp is a decision-support and verification tool. It is not an automated control system, not a substitute for operational judgment, and not a replacement for required site procedures, safety rules, inspections, supervision, or regulatory compliance.

5. No Accuracy Guarantee

OCR output, imported data, schema-based parsing, file normalization, and other software-assisted processing may contain errors, omissions, mismatches, or incomplete results. Users remain responsible for reviewing and confirming operational information before acting on it.

6. User Responsibilities

Users and deploying organizations are responsible for:

– ensuring only authorized personnel use the app

– reviewing operational information before reliance or action

– following applicable site rules, safety procedures, and legal obligations

– maintaining confidentiality of access credentials

– using the app in a lawful and authorized manner

7. Restrictions

You may not:

– reverse engineer, decompile, disassemble, copy, scrape, or create derivative works from the app

– attempt to bypass role restrictions, workflow controls, audit functions, or security features

– use the app for unlawful, unauthorized, or competitive misuse

– interfere with service integrity, data integrity, or other users’ authorized use

8. Data and Audit Records

The app may create and store audit records, workflow history, comments, evidence associations, and related logs. These records may be used for operational review, dispute handling, security review, and compliance purposes.

9. Availability

Four Eyez Company LLC may modify, suspend, limit, or discontinue all or part of the app at any time.

10. Intellectual Property

RailsVerifiedApp and all associated software, content, workflows, logic, documentation, and related intellectual property remain the exclusive property of Four Eyez Company LLC and its licensors.

11. Disclaimer of Warranties

RailsVerifiedApp is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, or accuracy.

12. Limitation of Liability

To the maximum extent permitted by law, Four Eyez Company LLC shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or for operational loss, safety incident, contamination, delay, business interruption, lost profits, lost data, or unauthorized acts by users or third parties arising from or related to use of the app.

13. Indemnification

You agree to indemnify and hold harmless Four Eyez Company LLC from claims, liabilities, damages, losses, and expenses arising from unauthorized use, misuse, violation of these Terms, or violation of law or third-party rights.

14. Termination

We may suspend or terminate access at any time for violation of these Terms, security reasons, misuse, or business reasons.

15. Governing Law

These Terms are governed by the laws of NEW JERSEY STATE, excluding conflict of laws principles.

16. Changes

We may update these Terms from time to time by posting an updated version.
